Sica, 52 Prospect Hill Road (20-31) George Sourati brought in a Geo-thermal well application for a closed-loop system, accompanied by an e-mail from the Mass Department of Environmental Protection issuing the Underground Injection Control UIC registration MAS41A062200-5CL, to be installed by Skillings & Sons, Inc.  Katie Carroll noted that every effort should be made to meet the 30-foot separation from the property line, possibly by moving the well closer to the septic system.  The Board noted that it does not have Chilmark regulations specific to ground source heat pump wells.  Marina Lent identified separations for closed-loop geothermal wells contained in the DEP Guidelines for Ground Source Heat Pump Wells as 10’ from potable water and sewer lines, 25’ from potential sources of contamination including, but not limited to septic tanks/fields, lagoons, livestock pens, and oil or other hazardous material storage tanks.  The Board approved the application, contingent upon receipt of the $50 fee and a copy of the UIC application to DEP, and also set the condition that these wells cannot be converted to drinking water uses as they do not meet required drinking water setbacks. The Board also asked George Sourati to mention to the homeowner the importance of minimizing the use of fertilizer on the property to protect water quality.

Galante, 18 Blacksmith Valley Road (35-12) George Sourati presented a plan for a replacement well to be drilled in the immediate vicinity of the existing well, which has failed and will be properly abandoned in accordance with DEP Private Well Guidelines.  The Board approved the application in principal, but has not yet received an application.  Board approval will also be contingent on receipt of a letter from the property owner, acknowledging that the new well (albeit a 4’ improvement in separation from the existing well) does not meet the separation required by Chilmark BOH Regulations from an abutting septic leaching system.  The old well must be properly abandoned in conformity with DEP Private Well Guidelines.

Nab’s Corner Homesite Housing Project (11-46) Reid Silva presented a four-bedroom septic system construction application which requires no variances.  The application was approved.

Vascellaro, 235 State Road (33-88) A proposed addition to the dwelling will require moving the septic tank and pump chamber, according to an application presented by Chris Alley.  The property is restricted to three bedrooms. The Board examined renovation plans to confirm bedroom count compliance of the proposed renovation, and approved the proposed septic plan.

Lurie, 4 Gosnold’s Way (20-106) Chris Alley requested a bedroom count for a floorplan of a proposed building housing a swimming pool, exercise center and theatre which will function as a private seasonal dwelling.  The Board determined a total bedroom count of six for the proposed floorplan.

BOH Annual Report 2014   The Board reviewed a draft annual report for 2014, and suggested amendments to it.  

Farm Stands: The Board discussed at what point a farm stand would require a Food Establishment Permit, and asked Marina Lent to make inquiries with the Department of Agricultural Resources and the Department of Public Health to get clear guidance on the responsibilities of the Board with regards to food sold on location at a Farm Stand.

Innovative/Alternative Systems:  Marina Lent reported on communications from a company servicing Bioclere I/A systems.  She noted that most I/A systems in Chilmark do not meet the operation and maintenance requirements, including regular inspections, required by State and Chilmark BOH regulations.  The Board will review enhanced I/A system monitoring at a future meeting.

2015 Food Establishment Permits:  
  • Chilmark Chocolates, Retail Permit with 3 variances: no separate hand wash sink in the kitchen; no 3-bay sink (use basins when warewashing between machine washings); hydrogen peroxide sanitizer.  
  • Menemsha Texaco with variances: no handwash sink (sani-wipes provided).

Banta, 11 South Abel’s Hill Road (24-229)  well completion report received, potability passes; per John Clarke, old well is not yet abandoned and report will be completed when that is done.

Lewenberg, 3 Osprey Lane (25-122) well completion report received, potability passes
